COMPLAINT HANDLING POLICY

Article 26 of Delegated Regulation 2017/565 requires investment firms to establish, implement and maintain effective and transparent complaints management policies and procedures for the prompt handling of clients' or potential clients' complaints. Investment firms shall keep a record of the complaints received and the measures taken for their resolution. The complaints management policy shall provide clear, accurate and up-to-date information about the complaints handling process. This policy shall be endorsed by the firm's management body.

TAX INFORMATION

FATCA

Minister of Finance of Cyprus has signed the FATCA Intergovernmental Agreement between Cyprus and USA (Intergovernmental Model 1 Agreement Foreign Account Tax Compliance Act) with the US ambassador, on the 2nd December 2014.

This agreement requires Cypriot Financial Institutions to identify financial accounts held by U.S. citizens or by entities that are incorporated in the U.S. or controlled by certain U.S persons and report those accounts annually to Cyprus Income Tax Authorities.

CRS

The Common Reporting Standard (CRS) has been initiated by the Organization for Economic Cooperation and Development (OECD) aiming at improving international tax compliance and preventing tax evasion, through the automatic exchange of information between the countries that implement CRS.

As of December 2015, 96 jurisdictions (including Cyprus) are adopting CRS. Cyprus Government was amongst the 58 jurisdictions that agreed to early adoption of the CRS and will start collecting information relating to the tax residence(s) and tax identification number(s) starting from January 1, 2016.

How this will affect you

Since Cyprus is an early adopter, starting 1st January 2016 all local Financial Institutions, including Atonline Limited, will need to comply with the requirements of the CRS and will contact clients (gradually during 2016) to collect certain information. Specifically, the collection of information will affect:

  • holders of new accounts opened on or after 1st January 2016 and
  • certain holders of pre-existing accounts i.e. accounts which were in existence on 31 December 2015,

This information will consist of their Jurisdiction(s) of Tax Residence and Tax Identification Number (TIN), among other fields where applicable, in the form of a:

Accounts held by Atonline Limited that fall within the scope of a Reportable Account in the CRS, will be subject to reporting on an annual basis.
